What is a Notary Public?

A notary public is an official of integrity appointed by state government — typically by the secretary of state — to serve as an unbiased and impartial witness on business, public and other documents. The most common function of the notary is to prevent fraud by attesting to the identity of a person signing a document.

What is a notarization?

A notarization on a document certifies that the person whose signature is entered on the document personally appeared before the notary, established his or her identity, and personally signed the document in the presence of the notary. It is a three-part process, performed by a Notary Public, that includes of vetting, certifying and record-keeping. Notarizations are sometimes referred to as "notarial acts."

Why are notarizations necessary?

Through the process of notarization, Notaries deter fraud and establish that the signer knows what document they are signing. Notaries also ensure the signer is a willing participant in the signing transaction.

The Different Notarial Acts

Acknowledgements

Documents typically requiring an acknowledgment are contracts, deeds, agreements, powers of attorney, etc. These documents contain terms to which the signer is agreeing. Documents requiring acknowledgment can be signed earlier than or at the time of notarization.

Oaths or Affirmations (Jurat)

Jurat notarizations are required for transactions where the signer must attest to the content of the document. Documents typically requiring an oath include written affidavits and applications—documents for which the signer/affiant has supplied a set of facts. Documents requiring an oath or affirmation must be signed in the presence of the notary.

Witness or Attest to a Signature

The act of witnessing or attesting a signature is similar to a jurat, however, the signer is not required to take an oath or affirmation. A notarization is required when establishing the signing date is of major importance.
